A User’s or Customer’s utilization of the Private Meal Prep Website constitutes an agreement that the User intends to be bound by these Terms and Conditions, including, but not limited to this website, social media accounts, and any other Private Meal Prep platforms.  Private Meal Prep reserves the right to update or modify these Terms and Conditions at any time and without notice. Utilization of this website constitutes your agreement to be bound by all such Terms and Conditions. Private Meal Prep encourages and expects each User and Customer to familiarize themselves with these Terms and Conditions.

These Terms and Conditions apply to all orders, purchases, and sales made by a Customer made under this Website, email, telephone, in person, or by any other means of communication or transmission.  This Website is provided on an “as is” and “as available” basis.

Private Meal Prep is not a medical provider or dietitian and should not be treated as such. The content of the Private Meal Prep and all affiliated information and documents are for informational purposes and should not be considered medical advice.  Please consult your medical provider concerning all matters regarding your health and we strongly encourage all Users and Customers to receive medical permission before the initiation of any diet or fitness regimen.

While Private Meal Prep can be a part of a User and Customer’s practice of fitness, safe dieting, and other physical activity the safety of the User and Customer is paramount and the sole responsibility of the User and Customer.  Any fitness, health, or dieting ideas offered by Private Meal Prep should not replace, nor take priority over medical advice or the personal judgment of the User or Customer’s body and its needs.

There is an inherent presence with any physical activity and dieting habits and by accessing or using the Private Meal Prep Website, products, or information, the User and Customer knowingly and willingly accept these risks.  By accessing any of those platforms, the User and Customer agree to these terms of responsibility and affirm that you intend to use them positively and safely.

Product Orders are shipped by Private Meal Prep each week on Mondays.  A Customer’s meals will be delivered by our courier service, with the anticipated delivery date to be selected by the Customer when an Order is placed.

All orders are final due to being perishable food. Except when required by law, paid subscription fees are non-refundable. Certain refund requests for subscriptions may be considered by Private Meal Prep, on a case-by-case basis and granted at the sole discretion of Private Meal Prep. There are no refunds unless otherwise stated.

Due to the perishable nature of our product, we are unable to accept any returns. However, your satisfaction is important to us. Please email connect@privatemealprep.com with any concerns you may have in regard to your order. In the case of misplaced, damaged, or incorrect orders, we offer refunds or credit at our discretion. Private Meal Prep reserves the right to require documentation and photographic evidence on any concerns.

On all subscriptions and Product Orders, Private Meal Prep requires a seven (7) day advance notice for any modifications, subscription adjustments, and cancellations. You acknowledge and agree that each meal order will automatically renew unless you cancel it or we suspend or terminate it in accordance with these terms.

Private Meal Prep will automatically renew your subscription and charge you for your payment method weekly. By ordering, you are authorizing and agreeing to the automatic renewal of your Meal subscription.

Your Payment Method will be charged at least two full days prior to your next Meal delivery date. We will charge your Payment Method with the applicable cost for your Meals, along with sales or similar taxes that may be charged with your Subscription.

To avoid being charged, you must skip your payment or cancel your Subscription in accordance with the Cancellation terms below. We will continue to bill your Payment Method on a recurring basis (depending on the Subscription and shipping frequency selected) until you cancel.

On all subscriptions and Product Orders, Private Meal Prep requires a seven (7) day advance notice for any modifications, subscription adjustments, and cancellations. Subscription Orders cannot be modified or canceled after the cut-off time. Unless notified by the subscriber before the cut-off, Private Meal Prep will prepare and deliver the meals selected in accordance with subscription terms and bill the credit card on file in accordance with our normal billing procedures. To cancel, give us a text at  (786) 983-6373 or email us at connect@privatemealprep.com. Cancellation requests submitted in this manner must be received at least seven (7) full business days prior to your next shipping date to avoid being charged for the Meal delivery. Cancellation requests received by Private Meal Prep through other channels, including, but not limited to, Social Media, may take up to seven (7) business days to process. On occasion,  Private Meal Prep may offer customers coupon codes, special offers, and/or discounts (hereafter, Offers), which may be distributed by email, social media, SMS, or displayed on the website. These are to be used in conjunction with the website when ordering  Private Meal Prep products and it is expected that customers will not exploit any such Offers to the detriment of  Private Meal Prep. Should any Customer attempt to obtain multiple Offers in violation of the terms of any such Offer, the Customer’s Order will be canceled in its entirety.  The redemption of any Offer by a Customer shall be at the sole discretion of  Private Meal Prep.

 Private Meal Prep, its subsidiaries, and affiliates are committed to protecting your privacy.   Private Meal Prep obtains personal information about Customers, such as a Customer’s name, address, email address, telephone number, dietary preferences, delivery and shipping preference, and other information voluntarily provided by a Customer through varying means of communication, and which is encrypted by  Private Meal Prep. Private Meal Prep uses this information solely for billing, shipping, and contacting a Customer as required.  Private Meal Prep’ customer list remains confidential and is not sold, rented, or leased to third parties.  On occasion,  Private Meal Prep does utilize outside sources for processing and delivery, processing transactions, or statistical analysis. These companies only receive the information required to complete the service and are required to keep all such information confidential

Some information such as your internet protocol (“IP”) address, operating system, browser type, language preferences, referring URLs, access times, pages viewed, links clicked and the like are automatically acquired through the visitation of our website. This information is not distributed or used for any purposes outside of  Private Meal Prep. Private Meal Prep website gathers some information through “cookies.” These cookies collect information such as visits, patterns, page views, and orders. No personal information is obtained this way, however they benefit your web experience. If you wish to disable cookies, you may do so through the settings on your computer. Private Meal Prep uses cookies to help keep track of items you put into your shopping cart, including when you have abandoned your cart, and this information is used to determine when to send cart reminder messages via SMS.

 Private Meal Prep allows its customers to create profiles that provide easier and more convenient access to products and benefits. The Customer is responsible for protecting usernames and passwords and is held responsible for activity performed from the account.

 Private Meal Prep grants the User and Customer with a nontransferable, limited, nonexclusive, license to access this website. Under this license, the User and/or Customer does not have the right to distribute or modify material.  This license prohibits the download or collection of logos, product descriptions, pricing, graphics, and any other media found on the website.  Private Meal Prep specifically prohibits the website from being reproduced, duplicated, copied, sold, or exploited for any purpose without express written consent from  Private Meal Prep. A User or Customer’s utilization of the website in an unauthorized manner immediately voids this license.  Tampering with the website, misrepresenting the identity of a user, using buying agents, or conducting fraudulent activities on the site are expressly prohibited.  A User or Customer violating these Terms and Conditions will be liable for such violations.

Any and all content sent in by Users or Customers to  Private Meal Prep is accompanied by the User or Customer’s express consent to be used by  Private Meal Prep as a royalty-free, nonexclusive, perpetual license, along with the irrevocable right to use, reproduce, modify, publish, distribute, display, and use creatively on any form of media.    Private Meal Prep is not responsible for this content, nor do we endorse or affirm any content provided by Users or Customers. Private Meal Prep is not liable for loss or damage attributable to any User or Customer content or submission.  The display of content, advertisements, and promotions from outside sources is not endorsed by  Private Meal Prep. As such, the accuracy of this content is not controlled by and therefore not warranted by  Private Meal Prep.

 Private Meal Prep does not retain responsibility for any human or mechanical error regarding the reliability, accuracy, timeliness, usefulness, adequacy, or sustainability of the website or other  Private Meal Prep platforms. Potential or actual delays, omissions, or loss of data are not guaranteed to occur. The guarantee that users will not be subject to any computer-based virus, worm, or computer code, that may result in the contamination of a third-party machine is not presently available.  Private Meal Prep can not guarantee that the website, blog, or social media will be uninterrupted or completely error-free indefinitely.

To the fullest extent permitted by applicable law,  Private Meal Prep, and its affiliates, shall not be liable to any User, Customer, or any third party for any damages, including, but not limited to direct, indirect, special incidental, consequential, or exemplary damages the result from the use of the website or any relation to the website and its content or the use of  Private Meal Prep products and services.   Further, and to the fullest extent permitted by applicable law, User and or Customer, on behalf of each’s heirs, executors, administrators, personal representatives and assigns hereby release, waive, and forever discharge Private Meal Prep and any of its affiliates, from and against, and covenant not to sue any such Private Meal Prep party for any and all claims you have or may have in relation to these Terms and Conditions and Private Meal Prep products and services.

The User and Customer, by accessing Private Meal Prep information agree to indemnify, defend, and hold Private Meal Prep, its members, officers, directors, employees, agents, licensors, suppliers, subsidiaries, and affiliates harmless from and against any claims, actions, demands, damages, awards, judgments, liabilities, and settlements including, without limitation, reasonable legal fees, expenses, and costs resulting from, or alleged to result from your violation of these Terms and Conditions, or any use by you of this website in any manner other than as expressly authorized in these Terms and Conditions.

Private Meal Prep and other indicated media on our website, social media, or e-mails distributed are copyrights and trademarks owned by Private Meal Prep. The use of copyrights, trademarks, trade dress, or anything of this nature in any manner that seeks to discredit or may confuse customers is directly prohibited. Any use of said copyrights and trademarks on products not concerning Private Meal Prep is expressly prohibited.  The United States and international trademark and copyright laws protect our content and we reserve all rights contained therein. This content includes, but is not limited to, text, logos, icons, graphics, images, video clips, and digital downloads.

Any concerns with Private Meal Prep products or content may be discussed and potentially resolved to the Customer’s satisfaction by contacting our customer service department at connect@privatemealprep.com or consulting the live chat on our website. 

By contacting Private Meal Prep and sharing your telephone number with the Company, you expressly agree to receive information, including confirmation of purchases and offers via email, and text/SMS message (SMS or MMS (text) messages, even if your telephone number(s) is/are currently listed on any state, federal or corporate Do Not Call list). Consent is not a requirement to purchase the goods or services that the Company offers. Standard text message rates and cellular data charges apply. You may opt out of our communications by replying “stop” to any message that you receive.

These Terms and Conditions and affiliated policies contain and solely dictate an agreement between Private Meal Prep and each User and Customer.

Private Meal Prep reserves the right to alter, modify, delete, and update these Terms and Conditions at any time. The User and Customer are strongly encouraged to review these Terms and Conditions regularly
